1. Purpose

The purpose of this privacy policy is to inform you about the types of information we gather about you when you visit our website or use the application, how we may use that information, whether we disclose it to anyone, and the choices you have regarding our use of, and your ability to correct, the information.

2. Definitions

  1. "Services" shall collectively mean the Playdate.help application or any of our services.
  2. "Service" shall mean the Playdate.help web application and its SMS and e-mail functions.
  3. "We", "Us", "PlayDateOrg", and "Our" shall refer to the Organizations and individuals providing the Service to You, including Lilith River.
  4. "Agreement" shall refer to this Privacy Policy

3. Age Restriction

During registration, you will be required to affirm that you are over 18 years of age and that you have read the Terms of Use and this Privacy Policy. The Services are exclusively for the use of adults and guardians and may not be used by minors.

5. Description Of Services

We are providing an application (the "Service") aimed at simplifying the process of sharing schedules by making it quick to broadcast (via SMS) your availability to friends you've added to your circle. By automating some of the awkward away, we hope to promote more social time for children.

The Service is designed to assist parents and guardians ("users", "you") in determining overlaps in free time between their children's schedules and their friends'. Children may not access or log into the service. The service does not perform any identity verification beyond confirming the validity of phone numbers through a confirmation link. The service does not offer searchability to connect with people unless you know their phone number. The service does not store actual meetings.

Our Service includes the following key features:

  1. Schedule Management: Users can easily create, edit, and view schedules to facilitate the organization of play dates. Users can attach emoticons to highlight periods they need coverage for as well as notes for specific openings. Our platform helps identify potential overlaps in free time between different households.

  2. Circle of Friends: Users can create a circle of friends - a list of other households that they (their household) are friends with. This circle serves as a primary source for potential play dates. Users can invite friends to join their circle and vice versa.

  3. Household Management: Users, specifically adults in a household, have full control over the management of their household information. This includes editing the household nickname and public notes/FAQ, adding/removing/editing children’s information, inviting or removing other adults to manage the household, and more.

  4. Sharing of Information: Upon accepting a friend invite from another household (or inviting another household to join their circle), users agree to share their household's schedule and notes, nickname, household's parents' names, parents' numbers, parent's notification status, children's names, dates of birth, and pronouns with that household. The Privacy Policy outlines the information that is collected and shared. This Shared Information helps friends in the circle to view and understand the availability of each household for play dates.

  5. SMS Based Authentication and Communication: We have adopted an SMS-based system for login and communication, offering a user-friendly and secure experience. By entering your phone number, you can receive a login link via SMS. This same channel is also used to broadcast texts to parents when you're free and send reminders to update schedules.

  6. Automatic Reminders: The Service offers automated reminders that help parents remember to fill out their schedules, keeping the system updated and functional.

  7. Schedule broadcasts The Service offers automated SMS broadcasts to parents in your circle when you're free, helping to facilitate the scheduling of play dates.

  8. Password-free security The Service exclusively uses SMS-based authentication (Magic Links) and does not use or store passwords, in order to keep user data safe. Using a login link sent to your phone will open your browser and set a cookie that will keep you logged in. This cookie is not accessible to other websites and is only used to keep you logged in to the Service.

6. Information Collected

By using the Service, you represent and warrant that you are 18 years of age or older.

  1. User Information: This includes your first and last name, phone number, email (optional), locale (language preference), time zone, and chosen pronouns. It also records whether your account is locked, why it might be locked, and your preferred reminder times and intervals. The date and time you accepted the terms of use are also noted.

  2. Household Information: For your household, the app collects the name of the household, public notes that you might add (optional), and the names of other members you've added to the household (optional).

  3. Child Information: For each child in the household, the app collects their first name, pronouns, and optionally their last name and date of birth as well as their association with the household.

  4. Contact Permissions: The app keeps track of your phone contact permissions such as blocked status, whether you allow invites and reminders. It also notes the date and time you accepted these terms (optional).

  5. Availability: The app collects information about your availability and that of each child in the household, including dates, start and end times (optional), availability status, and any notes or emoticons you add.

  6. Friend Requests and Household Connections: The app collects information about friend requests you send or receive, as well as any other households you're connected with as a friend.

  7. Invitations to manage the household: The app collects information about household management requests you send or receive.

  8. Safety and logins: The app generates magic login links and sends them to you when you request one. The app stores them for verification. When data is created or updated, the app will store the current time. The app may also permit users to report impersonations or make other safety reports, and will store the information you provide in the report. The app may also store information about your device, such as the device type, operating system, and browser type.

  9. User-provided Notes: The app allows users to enter arbitrary text into their Household notes, FAQ and schedule. This information is stored and shared with other households in the user's circle. The Service does not review or moderate this information. The User takes full responsibility for ensuring that this information is appropriate and does not contain any sensitive information they don't want accessible.

7. Who Can Access This Information

  1. Anonymous Users: a. By SMS: Households in your circle (and all adult phone numbers associated with them) may receive SMSes including some or all information you provide to the Service. b. Via Browser: If you're not logged in, you can only enter your phone number to receive a login link. You can't access or edit any user information in the app, although you can still receive notifications to your phone number that may include all the information otherwise accessible via the application.

  2. Logged-in Members: Once you're logged in, you can edit your own profile or delete it.

  3. Household Adult Members: As an adult member of a household, you have access to several privileges. You can: a. Edit the household nickname or FAQ and notes b. Add, view, remove, or edit children's information c. Invite other adults to manage the household or remove them d. Delete the household e. Invite friends to join the household Circle or remove them f. Edit the household's schedule g. Broadcast the household schedule and information to the Circle h. View your dashboard / overview

  4. Friends of the Household: If you've been added to a household's Circle, you can access shared information such as household notes, children's info (including first name, last name, date of birth, and pronouns), availability schedules, and availability notes. You can also see if household's and users you are connected to have disabled their notifications.

  5. Service administration: We and Administrators we assign have access to all the information in the Services, including the ability to delete users and household.

  6. Third-party services: The app uses third-party services to provide its functionality. These services may have access to your information. See the section on third-party services for more information.

  7. As our platform evolves, we may add new services or features to our platform. These Terms will apply to all new services and features unless we note otherwise.

8. How We Use This Information

  1. We collect and use this information in order to provide, maintain, protect, and improve the Service, to develop new ones, and to protect Us and our users.

  2. Service Provision: We use your information to deliver our Services, like processing the terms you search for in order to offer schedule management and friends circle features, or using your phone number for account authentication and communication.

  3. Service Improvement: We use the information we collect from all our services for the following purposes:

    • To ensure our services continue to meet your needs and wants.
    • To offer you customized content – like giving you more relevant search results and recommendations.
    • To understand how you use our services, so we can improve them.
  4. Communication: We may use your contact information to send you announcements related to our Services when we feel they may be of interest to you, with your consent where required. These might include updates to our Services, changes to our Terms of Use or Privacy Policy, or information about security issues.

  5. Safety and Security: We use the information we collect to make our services safe and secure, and to verify accounts and activity, combat harmful conduct, detect and prevent spam and other bad experiences, maintain the integrity of our services, and promote safety and security.

  6. We will ask for your consent before using information for a purpose other than those that are set out in this Terms of Use and Privacy Policy.

9. Information Sharing

We do not share your personal information with companies, organizations, or individuals outside of the Service except in the following cases:

  1. With your consent: We’ll share personal information outside of the Service when we have your consent. By adding a household to your circle, you consent for us to send all the information you enter in the application to all phone numbers associated with that household and to share all the information with users in that household.

  2. For external processing: We provide personal information to our affiliates and other trusted businesses or persons to store or process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures. For example, we use Twilio to send SMS messages to users, and Twilio may retain that data. See "Third Party Services" for more information. We use Railway and Supabase to store and run the application.

  3. For legal reasons: We will share personal information if we have a good-faith belief that access, use, preservation, or disclosure of the information is reasonably necessary to:

    • Meet any applicable law, regulation, legal process, or enforceable governmental request.
    • Enforce applicable Terms of Use, including investigation of potential violations.
    • Detect, prevent, or otherwise address fraud, security, or technical issues.
    • Protect against harm to the rights, property or safety of our users, Us, the Service, or the public as required or permitted by law.
  4. Non-identifiable information: We may share non-personally identifiable information publicly and with our partners – like publishers, advertisers, developers, or rights holders. For example, we share information publicly to show trends about the general use of our services.

If PlayDateOrg is involved in a merger, acquisition, or sale of assets, we’ll continue to ensure the confidentiality of your personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

10. Data retention

Users may delete their information from the app at any time. This information becomes immediately unavailable to others via the app. The data may remain accessible to administrators, third parties, and service providers in backups or other data stores for an indefinite amount of time. Information transmitted via SMS cannot be deleted or recalled. Users can control SMS notifications via the app or by replying STOP / UNSTOP.

11. Data Security

The Service exclusively uses SMS-based authentication (Magic Links) and does not use or store passwords, in order to keep user data safe. If you lose access to your phone number, please contact us. If another user gains access to your phone or phone number, they can impersonate you on the Service an gain access to the information stored therein.

The Service utilizes industry-standard measures to ensure the privacy and security of your personal information. However, we cannot guarantee that your communications with the Service will never be unlawfully intercepted or that your personal information will never be unlawfully accessed by third parties. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Service. We hope you take comfort in how little information we store and how little of it is sensitive.

12. Third-Party Services

The Service uses third-party services to provide its functionality. These services may have access to your information.

  1. Twilio: The Service uses Twilio to send SMS messages to users. Twilio may retain that data. See Twilio's privacy policy for more information.
  2. Railway: The Service uses Railway to host the application and to store user data. Railway may retain that data. See Railway's privacy policy for more information.
  3. Cloudflare: The Service uses Cloudflare to host the application. Cloudflare may retain information. See Cloudflare's privacy policy for more information.
  4. Supabase: The Service uses Supabase to store user data. Supabase may retain information. See Supabase's privacy policy for more information.

13. International Data Transfers

The Service is hosted within the United States and only accepts phone numbers from the United States and Canada. Your information may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you’re located outside the United States and choose to provide your information to us, we may transfer your information to the United States and process it there.

14. Children's Privacy

The Service is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use the Service or provide any information to us.

During registration, you will be required to affirm that you are over 18 years of age and that you have read the Terms of Use and this Privacy Policy. The Services are exclusively for the use of adults and guardians and may not be used by minors.

16. Limitation of Liability, Disclaimer of Warranties, and Indemnification

By using the Services, you agree to the following:

    • Unauthorized access to or alteration of your information
    • Any content or conduct of any third party on the Service
    • Any errors, mistakes, or inaccuracies in the Service
    • Any interruption or cessation of the Service
    • Any bugs, viruses, or other malicious code that may be transmitted to or through the Service
    • Personal injury or property damage resulting from your access to or use of our Service

Indemnification: You agree to defend, indemnify and hold us harmless from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the Service, violation of any terms or policies, or infringement of any rights of another person or entity.

  3. Third-Party Services: We are not responsible for the actions, privacy practices, or content of any third-party services used in conjunction with the Service, including any damages, losses, or injuries arising from their use.

  4. Disclaimer of Warranties: We provide the Service on an "as is" and "as available" basis, with all faults and without any warranty of any kind. We do not guarantee the accuracy, reliability, completeness, or timeliness of our Service or its content. We expressly disclaim all warranties, whether express, implied, statutory or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects in the Service will be corrected.

  5. No Professional Advice: The content provided by the Service is for informational purposes only and should not be construed as professional advice. We are not responsible for any decisions made based on the information provided by the Service.

  6. Severability: If any provision of the Terms of Use or Privacy Policy ("Agreements") is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Agreements will continue in full force and effect.

By using the Services, you acknowledge and agree to the limitations of liability, disclaimer of warranties, and the indemnification provisions described above. If you do not agree to these terms, please refrain from using the Service.

17. Governing Law and Jurisdiction

This Privacy Policy and your use of the Service shall be governed by and construed in accordance with the laws of the state of Colorado, United States, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Privacy Policy or the use of the Service shall be exclusively brought in the state or federal courts located in the state of Colorado, and you hereby consent to the personal jurisdiction and venue of such courts.

18. Changes to Our Terms of Use and Privacy Policy

Our Terms of Use and Privacy Policy may change from time to time. We will post any privacy policy changes on this page. We will also keep prior versions of this Privacy Policy in an archive for your review.

By continuing to use the Service after those changes become effective, you agree to be bound by the revised Terms of Use and Privacy Policy.

By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Terms of Use and Privacy Policy, and you hereby consent that we will collect, use, and share your information as described herein.
